THE LINCOLN Parish Police Jury met in regular session on Tuesday, August 9, 2011, at 7:00 p.m., at its regular meeting place in the Courthouse, Ruston, Louisiana. Present were: Theresa Moore Wyatt, District One; Bobby Bennett, District Three; Mike Franklin, District Four; David Hammons, District Five; Roy Glover, District Six; Jody Backus, District Seven; R. G. “Skip” Russell, District Eight; Joe Henderson, District Nine; Annie Brown, District Ten; Sharyon Mayfield, District Eleven; and R. D. “Mickey” Mays, District Twelve.
ABSENT: Hazel D. Hunter, District Two
Theresa Wyatt called the meeting to order and Roy Glover delivered the Invocation. President Wyatt then reviewed the Public Comment Procedure.
Bobby Bennett offered a motion, seconded by Sharyon Mayfield, to approve the agenda as amended. The motion carried with the following roll-call vote:
Yeas: Theresa Wyatt, Bobby Bennett, Mike Franklin, David Hammons, Roy Glover, Jody Backus, Skip Russell, Joe Henderson, Annie Brown, Sharyon Mayfield and Mickey Mays
Nays: None
Absent: Hunter
Theresa Wyatt recognized Senator Kostelka and Nick Geautreax, Commissioner of the Louisiana Department of Motor Vehicles. Sharyon Mayfield offered a motion, seconded by Roy Glover, to approve the minutes of the July 12, 2011 meeting. The motion carried with the following votes:
Yeas: Wyatt, Bennett, Franklin, Hammons, Glover, Backus, Russell, Henderson, Brown, Mayfield and Mays
Nays: None
Absent: Hunter
Theresa Wyatt asked for consent to move on to Item XI, Committee Reports, so that guests would not be detained. Hearing none opposing, Committee Reports were moved to the next item of business.
Skip Russell stated that the Public Works Committee met at 6:00 PM this day and the Committee recommends:
1. Approving the Industrial Driveway Policy as presented.
2. Approving the Administrator to review current building permit policies and fees and report back to the Committee.
3. Approving the award of the Braswell Lane Sign Installation and Pavement Markings, State Project No. H.00650.
Skip Russell offered a motion, seconded by Sharyon Mayfield to approve the minutes of the Public Works Committee. The motion carried with the following votes:

Roy Glover stated that the Public Property and Building Committee met at 6:30 PM this day and the Committee recommends:
1. Approving the Cooperative Endeavor Agreement with the Louisiana Department of Public Safety and Corrections for use of space.
2. Approving a resolution authorizing the collection of a $3.00 service fee by the Louisiana Department of Public Safety and Corrections.
3. Declaring the shelving and credenza in the old Movie Gallery as surplus property with the bidder taking all or none of the shelves.
Annie Brown offered a motion, seconded by Bobby Bennett, to approve the minutes of the Public Property and Buildings Committee. The motion carried with the following votes:

Skip Russell offered a motion seconded by Annie Brown to approve a resolution authorizing the collection of service fees by the Louisiana Department of Public Safety and Corrections.
RESOLUTION NO. 2011-30
A RESOLUTION REQUESTING THE SECRETARY, DEPARTMENT OF PUBLIC SAFETY AND CORRECTIONS TO ESTABLISH AND COLLECT A SERVICE FEE ON ALL MOTOR VEHICLE OFFICE TRANSACTIONS TO BE USED TO DEFRAY THE COST OF OPERATIONS OF A LOCAL FIELD OFFICE.
WHEREAS, the Lincoln Parish Police Jury provides a local field office for the Department of Public Safety and Corrections, Office of Motor Vehicles; and,
WHEREAS, the cost of operations of said local field office is not fully funded by the State; and,
WHEREAS, Louisiana Revised Statutes 32:429, enacted in the 1989 Regular Session and amended by the 1990 Session, authorizes any local government to levy a fee for each service or transaction carried out as an operation of a local field office of the Office of Motor Vehicles; and,
WHEREAS, the Lincoln Parish Police Jury, has found it necessary to collect such a fee to defray the cost of operations of the local motor vehicle office operation.
NOW THEREFORE BE IT RESOLVED on this 9th day of August, 2011 BY THE Lincoln Parish Police Jury, that:
SECTION I. There is hereby levied a fee of ($3.00) three dollars for each service or transaction carried out as an operation of a local field office of the Office of Motor Vehicles; and,
SECTION II. Theresa Wyatt, President is hereby authorized to enter into an agreement with the Secretary, Department of Public Safety and Corrections to have said Department collect said fee and then remit said fee to the Lincoln Parish Police Jury.
A vote being taken on the above resolution, the vote was as follows:

Joe Henderson offered a motion, seconded by Sharyon Mayfield, to authorize the President to sign a Cooperative Endeavor Agreement with the Louisiana Department of Public Safety and Corrections for the use of the old Movie Gallery Space. The motion carried with the following votes:

Item V, the appointment of Ms. Debbie Pender to the Lincoln Parish GIS District as the School Board Representative, was next on the agenda. Jody Backus offered a motion, seconded by Roy Glover, to appoint Ms. Pender.

Following a brief description of the procedural requirements for conducting a Board of Review and holding the necessary Public Hearing for property tax assessment purposes for the year 2011, David Hammons offered a motion, seconded by Joe Henderson, to recess the regular meeting of the Police Jury and convene as the Property Assessment Board of Review for the purpose of setting public hearing dates for the year 2011. The motion carried with the following votes:
Yeas: Wyatt, Bennett, Franklin, Hammons, Glover, Backus, Russell, Henderson, Brown, Mayfield and Mays

Convened as the Board of Review, the body reviewed the procedural requirements and the time table for conducting public hearings and certifying the assessment listing to the Louisiana Tax Commission. Skip Russell made a motion, seconded by Sharyon Mayfield that a public hearing be scheduled September 13, 2011 for the purpose of the Board of Review to consider the written or oral complaints of persons desiring to be heard, who had filed timely reports as required by state law relative to assessment of real or personal property in Lincoln Parish, Louisiana, for the year 2011. The motion carried with the following votes:

Roy Glover offered a motion, seconded by Annie Brown, to recess the Board of Review and reconvene the Police Jury meeting. The motion carried with the following votes:

Next on the Agenda was a report from Chief Deputy Assessor Sheila Bordelon. Ms. Bordelon stated that tax rolls will be open from August 15 through August 29, 2011 for public inspection and that appeals must be submitted to the Board of Review by 5:00 PM, September 6, 2011. Roy Glover offered a motion, seconded by Annie Brown, to approve a resolution authorizing the President to execute any necessary documents concerning property acquisition for FY 2011/2012 LCDBG Mt. Olive Water Project.
RESOLUTION NO. 2011-29
NOW, THEREFORE, BE IT RESOLVED that the Lincoln Parish Police Jury convened in Regular Session this 9th day of August, 2011 does hereby authorize the President Theresa Wyatt to execute any and all documents concerning property acquisition for FY 2011/2012 LCDBG Mt. Olive Water Project.

Under other business Annie Brown gave a brief update on the NACO meeting. There being no other business to discuss the meeting was adjourned.
