ORDINANCE AMENDING CHAPTER 29 OF THE CODE OF ORDINANCES OF THE CITY OF RUSTON, LOUISIANA BY CHANGING CERTAIN OF THE DISTRICT BOUNDARIES PROVIDED FOR THEREIN
WHEREAS, application was made under Case No. 1093 to the Zoning Commission of the City of Ruston, Louisiana, for reclassification of property referred to below:
Case No. 1093: Application for Zoning Amendment - From R-10 Single Family Residential to B-2 Light Business

Location: 104 King Avenue
Legal Description: Assessor's Parcel Number 36183147010; further described as: Lots 10, 11, 12, 13, 14, 15 and 16 of Mullins Additions to the Town of Ruston, Lincoln Parish, Louisiana, according to the plat and map of said addition on file and of record in Conveyance Book 28, page 135 of the records of the Clerk of Court of Lincoln Parish, Louisiana, LESS AND EXCEPT the West 125 feet of Lot 16 which is more particularly described as follows: Begin at the northwest corner of Lot 16 of Mullins Addition and run thence East along the North line of King Avenue for a distance of 125 feet, thence run Southerly parallel with the West line of said Lot 16 to the South line of Lot 16 a distance of 134 feet, thence run West to the southwest corner of said Lot 16 a distance of 125 feet, thence run northerly along the West line of Lot 16 to the starting point a distance of 134 feet; and
The North _ of the following described property, to-wit; Beginning at the southeast corner of the NW _ of NW _, Section 36, Township 18 North, Range 3 West, and run North for a distance of 315 feet for the starting point. From said starting point run North for a distance of 205 feet, more or less, to the southeast corner of Lot 10 of the Mullins Addition, thence run West along the South line of said Mullins Addition a distance of 408.5 feet, thence run South for a distance of 205 feet, more or less, to a point due West of the starting point, thence run East along old fence to starting point, all in the NW _ of NW 1/4 , Section 36, Township 18 North, Range 3 West, Lincoln Parish, Louisiana.
WHEREAS, the property requested to be reclassified is shown on attached Exhibit A; and, WHEREAS, after notice and advertisement regarding such application, a public hearing was held by said Zoning Commission on August 15, 2011; and, WHEREAS, on August 15, 2011, the Zoning Commission recommended that the property be reclassified as requested; and, WHEREAS, on August 15, 2011, the Zoning Commission recommended that the Future Land Use classification for the property be changed from Low Intensity Commercial to Commercial Node at such time as the Future Land Use map is revised; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RUSTON, LOUISIANA:
§1. Chapter 29 of the Code of Ordinances of the City of Ruston, Louisiana is hereby amended so as to reclassify the above described property to B-2 Light Business
§2. All Ordinances and parts of Ordinances in conflict herewith are hereby repealed, it being intended, however, that this Ordinance shall not in any manner change said Chapter 29 of the Code of Ordinances of the City of Ruston, Louisiana, except to reclassify to B-2 Light Business the above described property as referred to in §1.
§3. If any one or more of the provisions of this Ordinance shall, for any reason, be held to be illegal or invalid, such illegality or invalidity shall not affect any other provision of this Ordinance, but this Ordinance shall be construed and enforced as if such illegal or invalid provisions had not been contained herein. Any constitutional or statutory provision enacted after the date of this Ordinance which validates or makes legal any provision of this Ordinance which would not otherwise be valid or legal, shall be deemed to apply to this Ordinance.
§4. This Ordinance shall become effective upon final adoption and publication of same in the manner prescribed by law. This Ordinance was introduced on September 6, 2011, by Alderman Elmore Mayfield, Notice of public hearing was published on September 9, 2011, September 16, 2011, and September 23, 2011, and said public hearing having been held; the title having been read and the Ordinance considered, on motion to adopt by Alderwoman Glenda Howard, seconded by Alderman Elmore Mayfield, a record vote was taken and the following result was had:
