RESOLUTION NO. 768 OF 2011
RESOLUTION AUTHORIZING SALE OF DAMAGED TRANSFORMERS AS SURPLUS MOVABLE PROPERTY
WHEREAS, the City occasionally must replace damaged transformers; and, WHEREAS, the City has on site at its Public Works Department located at 701 E. Tennessee Avenue, several damaged transformers of varying sizes that are not needed by the City; and, WHEREAS, the City desires to sell all damaged transformers currently on site and all damaged transformers which will be collected during the calendar year 2012 (the “Transformers”); and, WHEREAS, the Transformers are no longer needed for public purposes and, as such, it is in the best interest of the City that such be disposed of through private sale; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RUSTON, LOUISIANA:
§1. The Transformers are declared to be no longer needed for public purposes.
§2. The City sell the Transformers pursuant to the following terms and conditions:
(a) Minimum Price: $1.00 per kVA.
(b) Bidders may bid price per kVA or a percentage of the Refiners Copper Scrap No. 1. Index.
(c) The Transformers shall be sold without warranty.
(d) The Transformers shall be removed from the City property at the expense of the purchaser within 30 days of the award.
(e) Payment shall be made to the City within seven (7) days from the date of the removal of the Transformers.
§3. The City Purchasing Agent is authorized and empowered to publish a notice that the Transformers are offered for sale to the highest bidder or bidders submitting sealed bids and to consummate the sales, provided that the price offered is equal to or greater than the minimum price set forth above. However, if no acceptable bids are received after the proposed sale is advertised one (1) time, (a) the Transformers may be re-advertised for sale as set forth above, or (b) the Transformers may be sold for the amount of the highest bid received or for the highest amount that can be obtained by the City Purchasing Agent whether or not such amount is equal to or greater than the minimum price set forth above, or (c) if no amount can be obtained for any of the Transformers, they may be disposed of in any reasonable manner. The Purchasing Agent is authorized to sign any acts of sales or other documents as may be required to convey title to the purchaser of the Transformers.
§4. This Resolution shall become effective upon final adoption and signature of the Mayor.
Said Resolution having been read and considered by a quorum of the Board of Alderman, on motion to adopt by Alderwoman Glenda Howard, seconded by Alderman Jedd Lewis, a record vote was taken and the following result was had:

WHEREUPON, the presiding officer declared the above Resolution duly adopted in full on this the 7th day of November, 2011.
