RESOLUTION NO. 770 OF 2011
RESOLUTION AUTHORIZING THE SALE OF SCRAP MATERIALS AS SURPLUS MOVABLE PROPERTY
WHEREAS, the City will generate scrap materials in calendar year 2012 (the “Scrap Materials” or “Property”) that cannot be utilized by the City and are not needed for public purposes; and, WHEREAS, the City desires to sell Scrap Materials currently on site and Scrap Materials which will be collected during the calendar year 2012; and, WHEREAS, the Scrap Materials are currently situated primarily at the Public Works Department at 701 E. Tennessee Avenue and on City property at other locations throughout the City; and, WHEREAS, the Scrap Materials are movable property having an appraised value of five thousand dollars or less, are no longer needed for public purposes and, as such, it is in the best interest of the City that such be disposed of through private sale; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RUSTON, LOUISIANA:
§1. The Scrap Materials are hereby declared to be no longer needed for public purposes.
§2. The City sell the Scrap Materials pursuant to the following terms and conditions:
(a) Minimum prices:
(1) Scrap iron (container service) - two cents ($0.02) per pound;
(2) Copper wire (container service) - one dollar seventy cents ($1.70) per pound; and
(3) Aluminum wire and sign blanks (container service) thirty ($.30) cents per pound.
(b) Other terms and conditions:
(1) All Scrap Materials shall be sold without warranty;
(2) All Scrap Materials shall be removed by the purchaser at the expense of the purchaser; and
(3) Payment shall be made to the City within seven (7) days from date of removal of scrap.
§3. The City Purchasing Agent is authorized and empowered to publish a notice that the Scrap Materials are offered for sale to the highest bidder or bidders submitting sealed bids and to consummate the sales, providing that the price offered is equal to or greater than the minimum price set forth above. However, if no acceptable bids are received after the proposed sale is advertised one (1) time, (a) the Scrap Materials may be re-advertised for sale as set forth above, or (b) the Scrap Materials may be sold for the amount of the highest bid received or the highest amount that can be obtained by the City Purchasing Agent whether or not such amount is equal to or greater than the minimum price set forth above, or (c) if no amount can be obtained for any of the Scrap Materials, they may be disposed of in any reasonable manner. The Purchasing Agent is authorized to sign any acts of sales or other documents as may be required to convey title to the purchaser of any of the Scrap Materials.
§4. This Resolution shall become effective upon final adoption and signature of the Mayor.
Said Resolution having been read and considered by a quorum of the Board of Alderman, on motion to adopt by Alderman Elmore Mayfield, seconded by Alderwoman Glenda Howard, a record vote was taken and the following result was had:

WHEREUPON, the presiding officer declared the above Resolution duly adopted in full on this the 7th day of November, 2011.
