CITY OF RUSTON
CERTIFICATION AND DECLARATION OF EMERGENCY PER LA. R.S. 38:2212(D)
I, Dan Hollingsworth, Mayor of the City of Ruston, Louisiana (“City”), a municipal corporation of the State of Louisiana, hereby certify and declare as follows: WHEREAS, a fire occurred on December 21, 2011, at the Public Works Complex (the “Public Works Complex”) of the City located at 701 East Tennessee Avenue in the City. WHEREAS, the fire began in the Repair Shop/Vehicle Maintenance Building (the “Repair Shop Building”) at the Public Works Complex and caused extensive damage to the Repair Shop Building as well as to the administrative building (the “Administrative Building”) at the Public Works Complex. WHEREAS, the Repair Shop Building is utilized by the City to maintain and repair all City vehicles used in the operation of various departments of the City. WHEREAS, the offices and work areas of virtually all upper level management and supervisory personnel of the City, including the City Administrator, Assistant City Administrator, City Planner and directors of various departments, including light and power, water utilities, street, planning & zoning and inspections, are located in the Administrative Building. WHEREAS, the activities which are performed in the Repair Shop Building and the Administrative Building are critical to the operation of the City and providing services to citizens of the City and it is necessary to reconstruct and/or repair said facilities without the inherent delays in compliance with La. R.S. 38:2211, et seq. WHEREAS, the fire represents an unforeseen mischance bringing with it destruction of property at the Repair Shop Building and the Administrative Building which requires construction or repairs which are needed to be performed without compliance with the formalities of La. R.S. 38:2211, et seq. thereby meeting the definition of emergency set forth in La. R.S. 38:2211(6). WHEREAS, pursuant to La. R.S. 38:2212(D), the fire and resulting damage to the Repair Shop Building and the Administrative Building at the Public Works Complex represents a public emergency and the City will not be required to follow the requirements of La. R.S. 38:2212(A), et seq. in the construction and/or repairs to the Repair Shop Building or the Administrative Building. ACCORDINGLY, as Mayor of the City, I hereby certify and declare that the fire and resulting damage to the Repair Shop Building and Administrative Building at the Public Works Complex which occurred on December 21, 2011, represents a public emergency pursuant to the provisions of La. R.S. 38:2212(D).
