RESOLUTION NO. 787 OF 2012
RESOLUTION AUTHORIZING THE CITY OF RUSTON TO PARTICIPATE IN THE STATE OF LOUISIANA COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM AND AUTHORIZING CERTAIN ACTIONS TO BE TAKEN BY THE CITY AS DESIGNATED BY THE STATE
WHEREAS, the City of Ruston (the “City”) has been afforded the opportunity to participate in the State of Louisiana Community Development Block Grant (“LCDBG”) program administered by the State of Louisiana, Division of Administration (the “State” or “DOA”); and, WHEREAS, the City has received a grant award from the 2008/2009 Louisiana Community Development Block Grant program (the “Program”) to construct improvements to the sanitary sewer system (the “Project”); and, WHEREAS, the City has received authorization to incur costs in accordance with the requirements of the Program; and, WHEREAS, the LCDBG Program requires that all grant recipients adopt by resolution a policy for communicating information to persons with sensory impairments; and, WHEREAS, the LCDBG Program requires that all grant recipients adopt by resolution an internal grievance procedure providing for prompt and equitable resolution of complaints alleging any action prohibited by the regulation of the U. S. Department of Housing and Urban Development, 24 CFR Part 8, implementing Section 504 of the Rehabilitation Act of 1973, as amended (Public Law 93-112); and, WHEREAS, Section 504 states, in part: “No otherwise qualified handicapped individual … shall, solely by reason of his handicap be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance”; and, WHEREAS, the Program requires that all grant recipients adopt, by Resolution, a plan to insure and certify that all activities of this and future grants will be operated in compliance with the requirements of Section 504 of the Rehabilitation Act of 1973, as amended, (the “Plan”); NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RUSTON, LOUISIANA:
§1. The “Section 504 - Policy on Procedures for Communicating Information to Persons with Sensory Impairments,” City of Ruston, dated May 3, 2010, is hereby adopted.
§2. The “Section 504 Grievance Procedures,” City of Ruston, dated May, 3, 2010, is hereby adopted.
§3. The City reaffirms and readopts the Plan which was adopted on May 20, 1994, as amended, which may be amended from time to time.
§4. The Mayor, Dan Hollingsworth, is authorized and empowered to execute any and all conveyance instruments, including purchase agreements, acts of sale or donation, rights-of-way, servitudes, or easements, related to said Project, and to execute any and all other documents necessary to complete said Project and to do any and all things necessary and proper to carry out this Resolution and to fulfill its objects and purposes.
§5. This Resolution shall become effective upon final adoption and signature of the Mayor.
This Resolution after having been read and considered on motion to adopt by Alderman Jedd Lewis, and seconded by Alderman Jim Pearce, a record vote was taken and the following result was had:
