Lincoln Parish Fire Protection District No. 1 Board of Commissioners met in regular session, Tuesday, June 12, 2012, at 5 o'clock p.m., at Lincoln Parish Fire Protection District No. 1 Vienna Station, Dubach, Louisiana, with the following members present: Chairman Tom Thompson, Mike Fulton, Willie Hendricks, Herbert Lyons, Layne Parnell, and Ray Robinson.
Absent: None.
The meeting was opened with an invocation given by Ray Robinson. A motion was made by Mike Fulton and seconded by Ray Robinson to approve the agenda as presented. The motion carried with the following votes:
For: Chairman Tom Thompson, Mike Fulton, Willie Hendricks, Herbert Lyons, Layne Parnell, and Ray Robinson.
Against: None.
Absent: None.
A motion was made by Ray Robinson and seconded by Willie Hendricks that the minutes from the last meeting be approved as written. The motion carried with the following votes:
For: Chairman Tom Thompson, Mike Fulton, Willie Hendricks, Herbert Lyons, Layne Parnell, and Ray Robinson.
Against: None.
Absent: None.
The following resolution was offered by Ray Robinson and seconded by Layne Parnell:
RESOLUTION 2012-02
A RESOLUTION levying within Fire Protection District No. 1 of the Parish of Lincoln, State of Louisiana, a service charge for the year 2012 in accordance with the provision of R.S. 40:1502.1 providing for the collection of said annual service charge and providing for other matters in connection therewith. WHEREAS, under the provisions of R.S. 40:1502.1 (the “Act”) and other constitutional and statutory authority supplemental thereto, the Board of Commissioners of Fire Protection District No. 1 of the Parish of Lincoln, State of Louisiana, is authorized to levy and collect within the boundaries of said District (the “District”), an annual service charge of Seventy-Two Dollars ($72.00) to be assessed persons owning residential or commercial structures, whether occupied or unoccupied, located wholly or partly within the boundaries of the District and that for the purposes of the assessment and collection of the service charge, each residential or commercial unit and each housing unit within a multiple dwelling structure shall be considered a separate structure and a mobile home, as defined in R.S. 9:1149.2(3), shall be considered a structure, all as provided in the Act. WHEREAS, pursuant to the requirements of the Act and other constitutional and statutory authority supplemental thereto, a special election was held in the District on October 2, 2010, to authorize the levy and collection of the service charge as set forth in the proposition attached hereto as Exhibit “A”, and said proposition was duly approved by a majority of the qualified electors voting in said election; and WHEREAS, in compliance with the aforesaid statutory authority and the said special election, it is the desire of this Board of Commissioners to levy said annual service charge in the District and provide for the collection of said service charge and other matters in connection therewith as hereinafter provided in the ordinance, NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Fire Protection District No. 1 of the Parish of Lincoln, State of Louisiana, that:
SECTION 1. Pursuant to the provisions of the Act and the proposition set forth as Exhibit “A” which was approved at a special election held on October 2, 2010, there is hereby levied an annual service charge of Seventy-Two Dollars ($72.00) in the year 2012 on each person owning residential or commercial structures, whether occupied or unoccupied, located wholly or partly within the boundaries of the District and that for the purposes of the assessment and collection of the service charge, owners shall be assessed a service charge for such structure which they own, and each residential or commercial unit and each housing unit within a multiple dwelling structure shall be considered a separate structure and a mobile home, as defined in R.S. 9:1149.2(3) shall be considered a structure, all as provided in the Act, stated in the proposition.
SECTION 2. Pursuant to the provisions of the Act, this Board of Commissioners is authorized to use any necessary and proper means to collect and enforce the collection of the service charge, including any means authorized by law for collection of taxes. Said service charge shall be due and owed by all persons subject to such charge on December 31, 2012.
SECTION 3. The Lincoln Parish Assessor is hereby authorized, empowered and directed to carry the fire protection service charges on the tax rolls for Lincoln Parish and the Lincoln Parish Sheriff shall collect such service charges at the time ad valorem taxes are collected. If any fire protection service charge becomes delinquent and unpaid, the sheriff shall send “Final Notices” to the delinquent property owners by registered or certified mail. He shall also publish the delinquent property owners' names and addresses in the parish journal setting forth the date and place of property sale to enforce collection in the same manner as for ad valorem taxes.
SECTION 4. This resolution shall be published in the official journal of the Board of Commissioners in the manner provided by law and shall be effective upon adoption. The above and foregoing Resolution was introduced by Ray Robinson who moved its adoption. The motion was seconded by Layne Parnell and was adopted by the following YEA and NAY vote:
YEAS: Tom Thompson, Mike Fulton, Willie Hendricks, Herbert Lyons, LayneParnell, and Ray Robinson.
NAYS: None.
ABSENT: None.
WHEREUPON, the resolution was declared duly adopted this 12th day of June, 2012.

EXHIBIT A
PROPOSITION
Shall Fire Protection District No. 1 of the Parish of Lincoln, State of Louisiana (the “District”), assess and collect an annual service charge of Seventy-Two Dollars ($72.00) from persons owning residential or commercial structures, whether occupied or unoccupied, located wholly or partly within the boundaries of the District, for a period of ten (10) years, beginning with the year 2011 and ending with the year 2020 (an estimated $612,000 reasonably expected at this time to be collected from the levy of the service charge for an entire year), both years inclusive, for the purpose of paying the costs of fire protection services and emergency services in and for the District, including the cost of acquiring, operating and maintaining equipment and facilities necessary for such services, and, for the purposes of assessing and collecting said service charge, owners shall be assessed a service charge for such structure which shall be considered a separate structure and a mobile home, as defined in R.S. 9:1149.2(3), shall be considered a structure, all provided in R.S. 40:1502.1?
Chief Ford stated that Cindy Dugdale would be retiring in August 2012. He asked that the Board authorize hiring a replacement for Mrs. Dugdale from the Civil Service list for Secretary to the Fire Chief. A motion was made by Layne Parnell and seconded by Ray Robinson to authorize Chief Ford to hire a Secretary to the Fire Chief at a beginning salary of $27,450.00 annually with a 5 percent raise after six months. The motion carried with the following votes:
For: Chairman Tom Thompson, Mike Fulton, Willie Hendricks, Herbert Lyons, Layne Parnell, and Ray Robinson.
Against: None.

Chief Ford recommended that the Board approve charge rates for extenuating circumstances such as emergency response to train derailments, hazardous materials incidents, etc. Charge rates (list attached) to be considered are as follows:

A motion was made by Mike Fulton and seconded by Herbert Lyons to approve charge rates referenced above. The motion carried with the following votes:

Chief Ford recommended hiring a maintenance contractor to mow fire station grounds at an approximate cost of $5,000.00. A motion was made by Ray Robinson and seconded by Herbert Lyons to hire a maintenance contractor to mow fire station grounds. The motion carried with the following votes:
For: Chairman Tom Thompson, Mike Fulton, Willie Hendricks, Herbert Lyons, Layne Parnell, and Ray Robinson.
Against: None.
Absent: None.
Chief Ford stated that the FCC has issued a mandate requiring communications equipment operated by state and local public safety entities be converted to narrow band. The total cost of new communications equipment is $25,718.00 (list attached) and funds will be taken from the Equipment Replacement Fund. He also stated that the cost of the repeater will be reimbursed by Homeland Security. A motion was made by Ray Robinson and seconded by Herbert Lyons to purchase new communications equipment as mandated by the FCC. The motion carried with the following votes:
For: Chairman Tom Thompson, Mike Fulton, Willie Hendricks, Herbert Lyons, Layne Parnell, and Ray Robinson.
Against: None.

A motion was made by Ray Robinson and seconded by Mike Fulton to amend the Operation and Maintenance and Equipment Replacement Budgets as follows:
Operating:

Uniforms from $10,000.00 to $10,500.00
Travel from $1,000.00 to $2,000.00
Construction Phase I from $480,169.00 to $442,113.00
Furniture & Fixtures from $1,500.00 to $41,156.00

Ruston Fire Department had requested that the Fire District sign a new mutual aid agreement with their department. Chief Ford stated that he would like to consult with District Attorney Shealy about the contents of the agreement and the possibility of revisions before it is signed. A motion was made by Mike Fulton and seconded by Herbert Lyons authorizing Chief Ford to sign mutual aid agreement with Ruston Fire Department after consultation with the Assistant District Attorney. The motion carried with the following votes:
For: Chairman Tom Thompson, Mike Fulton, Willie Hendricks, Herbert Lyons, Layne Parnell, and Ray Robinson.
Against: None.
Absent: None.
Chief Ford gave a brief update on the activities of the department. There being no public comments and no further business to come before the commission, the meeting was adjourned.
