ORDINANCE NO. 1629 OF 2012 ORDINANCE ADOPTING

ORDINANCE NO. 1629 OF 2012 ORDINANCE ADOPTING THE BUDGET OF REVENUE AND EXPENDITURES FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2012, AND ENDING SEPTEMBER 30, 2013, FOR THE CITY OF RUSTON, LOUISIANA
BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RUSTON, LOUISIANA:
§1. The Budget of Revenue and Expenditures (the "Budget") for the fiscal year beginning October 1, 2012, and ending September 30, 2013, of the City of Ruston, Louisiana (the "City"), dated August 20, 2012, is hereby adopted.
§2. The Budget and any future amendments thereto, shall constitute the authority of the Mayor and/or Department Heads of the City to incur liabilities and authorize expenditures from the respective budgeted funds for the year.
§3. In the exercise of the responsibility of the Board of Aldermen to define the authority of the Chief Executive Officer and Administrative Officers of the City to make changes within various budget categories without approval of the Board of Aldermen, as provided for in LSA-R.S. 39:1304(D), the Mayor, or Department Heads with approval of the Mayor, may make expenditures in individual line items providing that funds are available at the summarized object level, which is the legal level of control. The only exceptions are (a) the City Court and Probation budgets in which the legal level of control is the combined department level and (b) the City Marshal in which the legal level of control is the department level. For the purposes of this Ordinance, budget departments are those departments as presented in the Budget and listed in the table of contents of the Budget, and object categories are those defined in the Local Government Fiscal Manual Chart of Accounts, which are personal services, operating services, materials and supplies, travel and other, debt service, capital outlay and intergovernmental. Funds in the Budget which are not departmentalized shall be considered as one department. Any changes in amounts contained in the Budget for transfers to other funds shall require specific approval of the Board of Aldermen.
§4. A. In the exercise of its authority to regulate the hiring of municipal employees, as provided for in LSA-R.S. 33:362(A)(3), any changes in amounts contained in the Budget for regular salaries or regular overtime shall require specific approval of the Board of Aldermen.
B. The total number of regular and temporary employees of the City shall not exceed the total number of budgeted positions in the Budget without the approval of the Board of Aldermen. This limitation of the total number of employees is intended to be an exercise of the power of the Board of Aldermen to regulate the hiring of municipal employees under LSA-R.S. 33:362(A)(3).
C. No employee shall receive a pay increase, except a budgeted pay increase, during the budget year except for the following:
(1) In accordance with Pay Plan 2000;
(2) Anniversary pay increases for regular Police Department Employees;
(3) Pay increases for Fire Department employees for the receipt of EMT Basic, EMT Intermediate or Paramedic Certification.
§5. A. The Mayor shall advise the Board of Aldermen in writing within ten (10) calendar days after the determination that:
(1) There is a change in operations upon which the Budget was developed;
(2) Revenue collections plus revised projected revenue collections for the remainder of the fiscal year, within a fund, are failing to meet estimated annual budgeted revenues;
(3) Actual expenditures to date plus projected expenditures to year-end are exceeding budgeted amounts for those categories specified in §3 of this Ordinance; and,
(4) The actual beginning fund balance within a fund fails to meet the estimated beginning fund where the fund balance is being used to fund current year expenditures.
B. The Mayor and/or Department Heads must obtain approval of the Board of Aldermen before the actual expenditures and revised proposed expenditures for the remainder of the year of the applicable part of the Budget related to the various departments over which a Department Head may possess supervisory authority can exceed the budgeted expenditures or there is a change of operations within a department upon which the Budget was developed.
§6. The limitations of §5 and §6 are enacted pursuant to LSA-R.S. 39:1304(E), providing that proposed expenditures cannot exceed the total of estimated funds available for the ensuing fiscal year. The Mayor shall advise the Board of Aldermen in writing of any Budget amendment requests and provide the written reasons therefor prior to or at the time of introduction of the amendment to this Ordinance.
§7. The written notification required of the Mayor shall be retained by the Mayor and any responsive action taken by the Board of Aldermen shall be transmitted to and retained by the Mayor.
§8. If any one or more of the provisions of this Ordinance shall, for any reason, be held to be illegal or invalid, such illegality or invalidity shall not affect any other provision of this Ordinance, but this Ordinance shall be construed and enforced as if such illegal or invalid provisions had not been contained herein. Any constitutional or statutory provision enacted after the date of this Ordinance which validates or makes legal any provision of this Ordinance which would not otherwise be valid or legal, shall be deemed to apply to this Ordinance.
§9. This Ordinance shall become effective upon final adoption and publication of same in the manner prescribed by law.
This Ordinance was introduced on August 20, 2012, by Alderman Jedd Lewis, Notice of Public Hearing was published on August 23, 2012 and August 24, 2012, and said public hearing having been held, the title having been read and the Ordinance considered, on motion to adopt, by Alderman Jedd Lewis, seconded by Alderman Jim Pearce, a record vote was taken and the following result was had:
