THE LINCOLN Parish Police Jury met in regular session on Tuesday, August 14, 2012, at 7:00 p.m., at its regular meeting place in the Courthouse, Ruston, Louisiana. Present were: Theresa Wyatt, District One; Hazel D. Hunter, District Two; Bobby Bennett, District Three; Randy Roberson, District Four; David Hammons, District Five; Walter Pullen, District Six; Jody Backus; District Seven; Skip Russell, District Eight; Joe Henderson, District Nine; Nancy Wilson, District Ten; Sharyon Mayfield, District Eleven and Ronny Walker, District Twelve.
Absent: None
Theresa Wyatt called the meeting to order and Skip Russell delivered the Invocation. David Hammons offered a motion, seconded by Hazel Hunter, to approve the Agenda. There being no public comment on the matter the motion was voted upon and carried with the following votes:
Yeas: Wyatt, Hunter, Bennett, Roberson, Hammons, Pullen, Backus, Russell, Henderson, Wilson, Mayfield and Walker

Sharyon Mayfield offered a motion, seconded by Hazel Hunter, to approve the July 10, 2012 minutes. There being no public comment on the matter the motion was voted upon and carried with the following votes:

Following a brief description of the procedural requirements for conducting a Board of Review and holding the necessary Public Hearings for property tax assessment purposes for the year 2012, David Hammons offered a motion, seconded by Ronny Walker, to recess the regular meeting of the Police Jury and convene as the Property Assessment Board of Review for the purpose of setting public hearing dates for the year 2012. There being no public comment on the matter the motion was voted upon and carried with the following votes:

Convened as the Board of Review, the body reviewed the procedural requirements and the time table for conducting public hearings and certifying the assessment listing to the Louisiana Tax Commission. Jody Backus made a motion, seconded by Ronny Walker, that a public hearing be scheduled September 11, 2012 for the purpose of the Board of Review to consider the written or oral complaints of persons desiring to be heard, who had filed timely reports as required by state law relative to assessment of real or personal property in Lincoln Parish, Louisiana, for the year 2012. There being no public comment on the matter the motion was voted upon and carried with the following votes:

David Hammons offered a motion, seconded by Joe Henderson, to recess the Board of Review and reconvene the Police Jury meeting. There being no public comment on the matter the motion was voted upon and carried with the following votes:

Next on the Agenda was the Pictometry Critical 360 Demonstration. Homeland Security and Emergency Preparedness Director, Kip Franklin and Jackson Matthews of the GIS Office gave the presentation. No actions were taken. Parish Administrator, Courtney Hall, introduced an Ordinance to Adopt Millage Rates for the 2012 Year. Following discussion, Randy Roberson offered a motion, seconded by Bobby Bennett, to approve the Ordinance. The President called for public comment before the vote. Mr. Frank Cordaro expressed his opinion on the matter.

AN ORDINANCE LEVYING TAXES FOR REVENUE FOR EXPENSES OF THE LINCOLN PARISH POLICE JURY FOR THE YEAR 2012.
SECTION I. BE IT ORDAINED by the Lincoln Parish Police Jury in regular session convened, this 14th day of August, 2012, that in accordance with law and comfortable to the budget expenditures heretofore adopted by the Lincoln Parish Police Jury for the year 2012, and for the purpose of raising the necessary revenues to meet the charges and expenses of the Parish of Lincoln for the year 2012, there is hereby levied on all taxable property throughout the Parish of Lincoln, according to its value as may be finally assessed, the following taxes for the year 2012, to wit:
a. For general parish purposes (General alimony tax) on all taxable property inside the corporate limits of the City of Ruston, Louisiana (1.82) MILLS
b. For general parish purposes (General alimony tax) on all taxable property outside the corporate limits of the City of Ruston, Louisiana (3.65) MILLS
c. For the maintenance and/or improvements of public roads and bridges throughout Lincoln Parish, Louisiana (4.41) MILLS
d. For the construction, improvement and/or hard surfacing of public roads and bridges throughout Lincoln Parish, Louisiana (4.41) MILLS
e. For the purpose of operating, maintaining, constructing, and supporting a public library and its branches in Lincoln Parish, Louisiana (5.99) MILLS
f. For the purpose of constructing, improving, and acquiring equipment and furniture for the public library in Lincoln Parish, Louisiana (1.38) MILLS
SECTION II. BE IT FURTHER ORDAINED that the Assessor of Lincoln Parish, Louisiana, be and he/she is hereby directed to extend the above levies of taxes on the tax rolls of Lincoln Parish, Louisiana, for the year 2012. The foregoing ordinance was read in full, the roll was called on the adoption thereof, and the ordinance was adopted by the following votes:

Next on the Agenda was to consider adopting a resolution authorizing JEDCO Properties, LLC to participate in the Enterprise Zone Program. Ronny Walker offered a motion, seconded by David Hammons, to adopt the Resolution.
RESOLUTION NO. 2012-23
RESOLUTION STATING Lincoln Parish Police Jury's ENDORSEMENT OF JEDCO PROPERTIES, LLC OF RUSTON PARTICIPATE IN THE BENEFITS OF THE LOUISIANA ENTERPRISE ZONE PROGRAM; WHEREAS, the Louisiana Enterprise Zone Act 901 of 1981, Act 337 of 1982, Act 433 of 1987, Act 1024 of 1992, Act 581 of 1995, and Act 624 and Act 647 of 1997, and Act 977 of 1999; WHEREAS, the Louisiana Enterprise Zone Program offers significant incentives for economic development to some of the most distressed areas in the State; and WHEREAS, the Police Jury of Lincoln Parish states this endorsement is in agreement with the Overall Economic Development Plan for the Parish of Lincoln; and WHEREAS, the attached Enterprise Zone map has been marked to show the location of the business being endorsed; and WHEREAS, in accordance with the Louisiana Enterprise Zone Program requirements, the Police Jury of Lincoln Parish, Louisiana agrees:
1. To participate in the Enterprise Zone Program
2. To assist the Department in evaluating progress made in any enterprise zone within its jurisdiction
3. To REBATE all eligible parish sales/use taxes on the purchase of eligible construction materials, machinery, and equipment purchased for this project and used by the business permanently on that site.
BE IT RESOLVED by the Police Jury of Lincoln Parish, Louisiana, in regular and legal session convened this 14th day of August, 2012 that, JEDCO Properties, LLC is endorsed to participate in the Louisiana Enterprise Zone Program. BE IT FURTHER RESOLVED that if any provision or item of this resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications of this resolution which can be given effect without the invalid provisions, items or applications and to this end the provisions of this resolution are hereby declared severable. BE IT FURTHER RESOLVED that all resolutions or parts thereof in conflict herewith are hereby repealed.

Now, Therefore, Be It Resolved that the Lincoln Parish Police Jury convened in regular session this 14th day of August, 2012 does hereby certify that it will carry out the public housing program of Lincoln Parish in conformity with Title VI of the Civil Rights Act of 1964, The Fair Housing Act, Section 504 of the Rehabilitation Act of 1973, and Title II of the Americans with Disabilities Act of 1990, and hereby authorizes the President, Theresa Wyatt, to sign the Certifications.

Hazel Hunter stated that the Public Property and Buildings Committee met at 5:00 p.m. on August 13, 2012. She stated that a motion to enter into a Cooperative Endeavor Agreement with the Sheriff to lease the Road Camp Road property per the terms and conditions of the Agreement was presented. A substitute motion, to enter into a Cooperative Endeavor Agreement with the Sheriff to donate the Road Camp Road property per the terms and conditions of the Agreement was also presented. Both votes failed in a three-three tie and no action was taken. David Hammons offered a motion, seconded by Joe Henderson, to approve the minutes of the Public Property and Buildings Committee. The minutes were approved following a majority yea vote. At this time, Hazel Hunter offered a motion, seconded by Ronny Walker, that the Lincoln Parish Police Jury enter into a Cooperative Endeavor Agreement with the Lincoln Parish Law Enforcement District and the Sheriff of Lincoln Parish, transferring the entirety of the property located on Road Camp Road previously serving as the Highway Department property to the Lincoln Parish Law Enforcement District, in consideration for which the Lincoln Parish Law Enforcement District and the Sheriff of Lincoln Parish agree to the terms and conditions as drafted by Parish Legal Counsel and to authorize the President to execute the Agreement. Randy Roberson then offered a motion, seconded by Bobby Bennett, to table the motion. The motion was voted upon and failed with the following votes:

2. Nominating Ms. Jerrilene Washington as the Professional Appointee and Ms. Joyce Brazzel as the Advocate Appointee for the Northeast Delta Human Services Authority.
3. Nominating Mr. Rick Holt as the appointee for the Sparta Groundwater Conservation District.
4. Accepting the nomination of Cathi Cox-Boniol from the Keep Lincoln Parish Beautiful Commission.
David Hammons offered a motion, seconded by Hazel Hunter, to approve the minutes of the Personnel/Benefits Committee. There being no public comment, the motion carried with the following votes:
