ORDINANCE NO. 1631 OF 2012 ORDINANCE AMENDING
ORDINANCE NO. 1631 OF 2012 ORDINANCE AMENDING SECTION 11-300 OF CHAPTER 11 OF THE CODE OF ORDINANCES OF THE CITY OF RUSTON, LOUISIANA, RELATIVE TO POSSESSION OF MARIJUANA BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RUSTON, LOUISIANA:
§1. Section 11-300 of Chapter 11 of the Code of Ordinances of the City of Ruston, Louisiana, is hereby amended to read as follows: Sec. 11-300. Possession of marijuana or synthetic cannabinoids.
(a) It shall be unlawful for any person to knowingly and intentionally possess marijuana, tetrahydrocannabinol or chemical derivatives thereof or synthetic cannabinoids.
(b) For the purposes of this section,
(1) The term “marijuana” means all parts of plants of the genus Cannabis, whether growing or not; the seeds thereof; the resin extracted from any part of such plant; and every compound, manufacture, salt, derivative, mixture or preparation of such plant, its seeds or resin; but shall not include the mature stalks of such plant, fiber produced from such stalks, oil or cake made from the seeds of such plant, any other compound, manufacture, salt, derivative, mixture or preparation of such mature stalks (except the resin extracted therefrom), fiber, oil or cake, or the sterilized seed of such plant which is incapable of germination.
(2) The term "synthetic cannabinoids" means any material, compound, mixture, or preparation, which contains any quantity of a synthetic cannabinoid found to be in any of the following chemical groups, or any of those groups which contain any synthetic cannabinoid salts, isomers, or salts of isomers, whenever the existence of such salts, isomers, or salts of isomers is possible within the specific chemical designation, including all synthetic cannabinoid chemical analogues in such groups:
(i) Naphthoylindoles whether or not substituted in the indole ring to any extent or the naphthyl ring to any extent.
(ii) Naphthylmethylindoles whether or not substituted in the indole ring to any extent or the naphthyl ring to any extent.
(iii) Naphthoylpyrroles whether or not substituted in the pyrrole ring to any extent or the naphthyl ring to an extent.
(iv) Naphthylmenylindenes whether or not substituted in the indene ring to any extent or the naphthyl ring to any extent.
(v) Phenylacetylindoles whether or not substituted in the indole ring to any extent or the phenyl ring to any extent.
(vi) Cyclohexyphenols whether or not substituted in the cyclohexyl ring to any extent or the phenyl ring to any extent.
(vii) Dibenzopyrans whether or not substituted in the cyclohexyl ring to any extent or the phenyl ring to any extent.
(viii) Benzoylindoles whether or not substituted in the indole ring to any extent or the phenyl ring to any extent.
(c) Any person found guilty of possession of marijuana or synthetic cannabinoids shall be fined not more than $500.00 and/or be imprisoned for not more than 60 days.
(d) The provisions of this section shall not apply to any person who has a prior conviction under R.S. 40:966(C) with regard to marijuana or synthetic cannabinoids, or this section.
§2. If any one or more of the provisions of this Ordinance shall, for any reason, be held to be illegal or invalid, such illegality or invalidity shall not affect any other provision of this Ordinance, but this Ordinance shall be construed and enforced as if such illegal or invalid provisions had not been contained herein. Any constitutional or statutory provision enacted after the date of this Ordinance which validates or makes legal any provision of this Ordinance which would not otherwise be valid or legal, shall be deemed to apply to this Ordinance.
§3. This Ordinance shall become effective after final adoption and publication of the same in the manner prescribed by law as of January 1, 2013.
This Ordinance was introduced on November 5, 2012, by Alderman Elmore Mayfield; notice of public hearing was published on November 9, 2012, and said public hearing having been held, the title having been read and the Ordinance considered, on motion to adopt by Alderman Elmore Mayfield, seconded by Alderman Jedd Lewis, a record vote was taken and the following result was had:
