RESOLUTION NO. 832 OF 2013
RESOLUTION AUTHORIZING CITY TO ENTER INTO A BALANCING AUTHORITY SERVICES AGREEMENT WITH ENTERGY ARKANSAS, INC.
WHEREAS, the Energy Policy Act of 2005 authorized the Federal Energy Regulatory Commission (“FERC”) to approve Reliability Standards with which users, owners, and operators of the bulk power system are required to comply; and, WHEREAS, FERC has approved certain Reliability Standards and associated requirements proposed by the North American Energy Reliability Corporation (“ NERC”), the electric reliability organization authorized by the Energy Policy Act of 2005 to develop such standards; and, WHEREAS, NERC holds entities responsible for compliance with particular Reliability Standards based on the function those entities perform with respect to the operation of the bulk power system; and, WHEREAS, Entergy Arkansas, Inc. (“EAI”) will be the Local Balancing Authority (“LBA”) for the EAI LBA Area that operates in the Midwest Independent Transmission System Operator, Incorporated (“MISO”) Balancing Authority; and, WHEREAS, the MISO First Revised Rate Schedule FERC No. 3 requires an LBA to know the status of all resources, generation, and transmission available for use in its LBA Area; and, WHEREAS, the City either (1) owns bulk electric facilities and is engaged in the generation and sale of electric power and energy from those facilities; (2) is connected to such facilities operated within the EAI LBA Area; and/or (3) serves load in the EAI LBA Area; and, WHEREAS, the City and EAI each desire to establish responsibility for maintaining compliance with the applicable NERC Balancing Authority Reliability Standards and MISO requirements within the EAI LBA Area; and, WHEREAS, EAI has submitted a proposal to provide balancing authority services relating to supplying power to the City (the “Services”); and, WHEREAS, the City desires to enter into a balancing authority services agreement with EAI relating to the Services (the “Agreement”); NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF ALDERMEN OF THE CITY OF RUSTON, LOUISIANA:
§1. The City enter into Agreement with EAI for the Services.
§2. The Mayor, Dan Hollingsworth, is authorized and empowered to execute an Agreement with EAI for the Services, to be on such terms and conditions as he shall deem proper, and to execute any and all documents necessary and to do any and all things necessary and proper to carry out this Resolution and to fulfill its objects and purposes.
§3. This Resolution shall become effective upon final adoption and signature of the Mayor.
Said Resolution having been read and considered by a quorum of the Board of aldermen, on motion to adopt by Alderman Jedd Lewis, and seconded by Alderman Jim Pearce, a record vote was taken and the following result was had:
