ORDINANCE NO. 1605 OF 2011
ORDINANCE ANNEXING APPROXIMATELY 17.5 ACRES OF LAND INTO THE CORPORATE LIMITS OF THE CITY OF RUSTON, LOUISIANA
WHEREAS, a Petition was received by the Mayor and Board of Aldermen requesting the annexation into the corporate limits of the City of Ruston, Louisiana, of the following described property (the “Property”) located in Section 7, Township 18 North – Range 2 West, Land District North of Red River, Lincoln Parish, Louisiana, being more particularly described as follows: Beginning at a point on the existing City Limits boundary, said point representing the Southwestern corner of the SE 1/4 of the SE 1/4 of Section 7, Township 18 North – Range 2 West, and run thence Westerly along the Southern line of said SE 1/4 of SE 1/4 and along the existing Corporate Limits for an approximate distance of 245 feet and to a point representing the corner common with Lincoln Parish Parcel 18182444001 (South), Lincoln Parish Parcel 07182HOD027 (Northwesterly) and with Lincoln Parish Parcel 07182000037 (Northeasterly); thence turn right and proceed, along the boundary common with said parcels 07182HOD027 and 07182000037, for an approximate bearing of N 00°00’00” E and approximate distance of 210.00 feet and to a point representing the corner common with said parcels and with the Lincoln Parish Parcel 07182000015 (Northeasterly); thence turn right and proceed, along the boundary common with said parcels 07182HOD027 and 07182000015, for an approximate bearing of N 11°43’43” E and approximate distance of 310 feet and to the intersection with the Southern right-of-way of Hodges Road; thence turn left and proceed, along the said Southern right-of-way, for an approximate bearing of N 84° W and approximate distance of 91.92 feet and to a point; thence turn right and proceed, along said right-of-way, for an approximate bearing of N 76 ?° W and approximate distance of 75 feet and to a point representing the intersection with the Southerly projection of the Western boundary of Parcel 07182HOD009; thence turn right and proceed, along said projection and across said Hodges Road, for an approximate bearing of N 02°47’47” W and approximate distance of 83.5 feet and to a point representing the intersection with the Northern right-of-way of said Hodges Road and the Southwestern corner of said Parcel 07182HOD009; thence proceed, along the Western boundary of said Parcel, for a continued approximate bearing of N 02°47’47” W and approximate distance of 433.35 feet and to a point representing a Northwestern corner of said parcel; thence turn right and proceed, along a Northern boundary of said Parcel, for an approximate bearing of S 77° 24’ 58” E and approximate distance of 419.05 feet and to a point representing the Southwestern corner of Parcel 07182033041; thence turn left and proceed, along a Western boundary of said Parcel, for an approximate bearing of N 12°35’46” E and approximate distance of 260.77 feet and to a point and corner; thence turn right and proceed, along a Northern boundary of said Parcel, for an approximate bearing of S 69°05’28” E and approximate distance of 102.60 feet and to a point and corner; thence turn left and proceed, along a Western boundary of said Parcel, for an approximate bearing of N 32°00’53” E and approximate distance of 271.00 feet and to a point representing Northwestern corner of said parcel and the intersection with the Southwestern right-of-way of Road Camp Road; thence turn right and proceed, along said right-of-way, for an approximate bearing of S 58°11’56” E and approximate distance 106.39 feet and to a point and corner; thence turn right and proceed, along said right-of-way, for an approximate bearing of S 22°42’48” E and approximate distance 123.13 feet and to a point representing the intersection with the said Northwestern right-of-way of Louisiana Highway No. 33; thence turn left and proceed, perpendicular to the said right-of-way of Louisiana Highway No. 33, and across said Louisiana Highway No. 33 right-of-way, for an approximate bearing of S 77°12’52” E and approximate distance of 78.19 feet and to a point representing the intersection with the Southeastern right-of-way of said Louisiana Highway No. 33; thence turn right and proceed, along said Southeastern right-of-way, for an approximate bearing of S 05°25’21” W and approximate distance of 89.07 feet and to a point;
thence turn right and proceed, along said Southeastern right-of-way, for an approximate bearing of S 12°48’05” W° W and approximate distance of 132.32 feet and to a point; thence turn right and proceed, along said Southeastern right-of-way, for an approximate bearing of S 17°38’59” W and approximate distance of 115.25 feet and to a point; thence turn left and proceed, along said Southeastern right-of-way, for an approximate bearing of S 12°12’34” W and approximate distance of 103.12 feet and to a point; thence turn left and proceed, along said Southeastern right-of-way, for an approximate bearing of S 02°37’18” W and approximate distance of 14.25 feet and to a point;
thence turn right and proceed, along said Southeastern right-of-way, for an approximate bearing of S 12°45’18” W and approximate distance of 487.17 feet and to a point; thence turn left and proceed, along said Southeastern right-of-way, for an approximate bearing of S 77°13’41” E and approximate distance of 15.00 feet and to a point; thence turn right and proceed, along said Southeastern right-of-way, for an approximate bearing of S 12°48’02” W and approximate distance of 259.74 feet and to a point representing the approximate position of the intersection with the aforesaid Southern boundary of the SE 1/4 of the SE 1/4 of Section 7; thence turn right and proceed, along said Southern boundary of SE 1/4 of SE 1/4 and across said Louisiana Highway No. 33 , for an approximate bearing of N 90° W and approximate distance of 75.02 feet and to a point representing the intersection with the aforesaid Northwestern right-of-way of Highway No. 33; thence proceed, along said Southern boundary, for an approximate bearing of N 90° W and approximate distance of 231.55 feet and back to the POINT-OF-BEGINNING of herein-described annexation, containing approximately 17.50 acres.
WHEREAS, the Lincoln Parish Assessor and the Lincoln Parish Registrar of Voters have certified that said Petition was signed by the requisite number of property owners and registered voters; and, WHEREAS, due notice of the receipt of the Petition was given as required by R.S. 33:172, and no request was made by anyone for a hearing; and, WHEREAS, it is in the best interest of the City to annex the Property into the corporate limits of the City; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF RUSTON, LOUISIANA:
§1. The Property is hereby annexed into the corporate limits of the City of Ruston, Louisiana.
§2. The Property shall be zoned and future land use established as described below and shall be subject to zoning requirements set forth in the Code of Ordinances of the City of Ruston, Louisiana:
Zoning: B-3 General Business District Zoning.
Future Land Use: High Intensity Commercial
§3. This Ordinance shall become effective after final adoption and publication of same in the manner prescribed by law. This Ordinance was introduced on December 6, 2010, by Alderman Jedd Lewis; Notice of Public Hearing was published on December 10, 2010, December 17, 2010, and December 23, 2010, a Public Hearing was held, the title having been read and the Ordinance considered, on motion to adopt by Alderman Jim Pearce, seconded by Alderman Elmore Mayfield, a record vote was taken and the following result was had:
